Brooks Wish and Win Promotion Official Rules
How to Enter:
No Purchase Necessary. To enter, create and add items to your "Wish List" on the Brooks Sports website -- www.brooksrunning.com -- (the "Website") by following the instructions found on the Website. Promotion runs from November 9, 2011 through December 9, 2011 (the "Promotion Period"). Entries must be posted to the Website by 11:59 P.M Pacific Time on December 9, 2011. Entries received after that time are void and will not be considered. Limit one entry per person, per email address, per Website account. Once submitted, an entry cannot be deleted, canceled, or modified. In the event of a dispute as to entries submitted by multiple individuals using the same e-mail account, the entrant is deemed to be the natural person who is assigned the applicable e-mail address by an internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.
Eligibility:
To be eligible, must be a resident of the U.S. that is at least 18 years of age. Employees of Brooks Sports and its affiliated companies are not eligible to win.
Winners:
6 winners will be selected at random by Brooks Sports from all "Wish List" entries created during the Promotion Period. Winners will be notified by e-mail the week of December 12, 2011. The first winner selected will win the grand prize. The next five winners selected will win the runner up prizes in the order selected. If a winner is not eligible for any reason, Brooks Sports will randomly select another winner from the remaining eligible entries.
Prizes:
Prizes are BROOKS SPORTS® prize packages of products included in the winners' "Wish List" up to an approximate retail value (ARV) for the grand prize package of $500 or a pair of Brooks shoes of the winner’s choice (up to an ARV of $140) for each of the runner up prize packages. All prize packages are subject to product availability and the ARV caps referenced above. Prizes will be redeemed through an award certificate provided to winners that must be completed and returned to Brooks for order processing. Prizes will be mailed to the winner at the address he/she provides. Prize orders will be filled after December 19, 2011. Allow 3-6 weeks for delivery.
General:
By entering this Promotion, each entrant acknowledges and agrees that he or she has read and agrees to abide by all of these Promotion rules and that he or she is not prohibited from participating in the Promotion. Participation in this Promotion constitutes entrant’s full and unconditional acceptance of these rules and the decisions of Brooks Sports with respect to the administration of the Promotion, which are final, binding and non-negotiable in all respects. Brooks Sports, its subsidiaries and affiliates, and each of their respective officers, directors, agents and employees, are collectively referred to as the "Released Entities." By participating, each entrant releases, discharges, indemnifies and holds harmless the Released Entities from any liability arising from or related to the Promotion and/or the receipt or use of the prizes awarded in connection with the Promotion, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. Further, each entrant fully and unconditionally releases, by way of example and not limitation, all claims for consideration, violation of the right of publicity or privacy, copyright infringement and all other claims of any nature relating from the use of entrant’s name or likeness, and all other claims of any nature resulting from Brooks Sports’s use of information collected as a result of the participation in this Promotion by any entrant or the award or subsequent use of any prize. Any use of the information collected as a result of the participation in this Promotion by any entrant will be governed by the terms of Brooks Sports's Privacy Policy.
No purchase necessary to enter. Any tax liability on prizes is solely the responsibility of the winner. This Promotion is void in Rhode Island, outside of the United States, and where prohibited by law. Prizes are not exchangeable, transferable and cannot be redeemed for cash. All entries submitted become the property of Brooks Sports and will not be returned. Brooks Sports reserves the right to correct errors in materials in conjunction with this Promotion. Standard product warranties apply to all prizes.

Brooks Sports is not responsible for electronic transmission errors resulting in omission, interruption, deletion, or delay of entries. Brooks Sports is not responsible for theft or destruction or unauthorized access to or alterations of Promotion materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind. Brooks Sports is not responsible for inaccurate transmissions of or failure to display Promotion materials on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, Brooks Sports reserves the right at its sole discretion to cancel, terminate, modify or suspend this Promotion.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE ADMINISTRATOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Severability:
